These Affiliate Program Terms (the “Terms”) govern your participation in the Ettex Affiliate Program (the “Program”), operated by Ettex (“Ettex”, “we”, “us”). They are separate from, and in addition to, the Ettex Terms of Service and Privacy Policy. By enrolling in or promoting Ettex as an affiliate you agree to these Terms.
“Affiliate”, “you” — a person or entity approved to promote Ettex and earn commissions under the Program.
“Referral Link” — a unique tracking link (or coupon/click identifier) we assign to you.
“Referred Customer” — a new customer who signs up for a paid Ettex plan after clicking your Referral Link within the attribution window.
“Qualifying Sale” — a paid, non-refunded subscription payment made by a Referred Customer.
“Commission” — the amount payable to you for Qualifying Sales as set out in these Terms.
Participation is free and subject to our approval. We may accept or decline any application, or remove any Affiliate, at our discretion.
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into a binding agreement.
You must provide accurate account, contact, tax and payout information and keep it current.
You are an independent contractor, not an employee, agent, partner or joint venturer of Ettex. You have no authority to make commitments on our behalf.
You are solely responsible for your own taxes, expenses, staff and promotional activities.
Referrals are tracked via your Referral Link and a 30-day, last-click cookie. If a visitor clicks your link and starts a paid plan within 30 days, the sale is attributed to you (subject to last-click and to no conflicting registered referral).
Attribution depends on the customer’s browser and consent settings; we are not liable for referrals we cannot track (e.g. blocked cookies, cleared storage, or another affiliate’s later click).
Self-referrals — purchases you make for your own account or business — do not qualify for Commission.
For each Qualifying Sale, you earn 30% recurring commission on the net subscription revenue (excluding taxes, refunds, chargebacks and discounts) for up to 12 months from the Referred Customer’s first payment, for as long as that customer keeps an active paid subscription during that period.
Commission is calculated in USD on amounts actually received by Ettex. Discounts, credits, taxes and third-party fees are excluded.
Commissions are held for a 30-day review period after each Qualifying Sale (to allow for refunds/chargebacks) before becoming available for payout.
Payouts are made monthly in USD, via Stripe or PayPal, once your available balance meets the applicable minimum payout threshold (currently $50).
You are responsible for providing valid payout details and any required tax forms (e.g. W-9/W-8). We may withhold payment where required by law or where details are missing.
If a Referred Customer refunds, charges back or cancels within the review period, the related Commission is reversed (clawed back) from your pending or available balance.
Unpaid balances below the threshold roll over to the next period.
You must promote Ettex lawfully, honestly and in line with these Terms and any brand guidelines we provide.
You must clearly disclose your affiliate relationship wherever required (e.g. FTC guidelines and equivalent local rules).
Prohibited: spam or unsolicited messaging; misleading, false or deceptive claims; trademark bidding on “Ettex” or confusingly similar terms in paid search; typosquatting or cookie-stuffing; coupon/deal listings we have not authorized; adult, illegal, hateful or infringing content; and any automated or fraudulent traffic.
You must not make representations about Ettex, its pricing or features beyond our official materials.
We grant you a limited, revocable, non-exclusive, non-transferable license to use Ettex names, logos and approved creatives solely to promote Ettex under the Program, per our brand guidelines.
You gain no other rights in our intellectual property. All goodwill from your use accrues to Ettex. We may revoke this license at any time.
Non-public information we share with you (including Program terms, rates and statistics) is confidential and must not be disclosed or used except to participate in the Program.
These Terms apply while you participate in the Program. Either party may terminate at any time, for any reason, with notice (including via your dashboard or email).
On termination you must stop using our brand and Referral Links. We will pay any earned, cleared Commission above the threshold on the next payout cycle; unqualified or clawed-back amounts are not payable.
We may suspend or terminate participation and withhold Commission for suspected fraud or breach of these Terms.
The Program and any materials are provided “as is”, without warranties of any kind. We do not guarantee any level of traffic, conversions or earnings.
To the maximum extent permitted by law, Ettex is not liable for indirect, incidental or consequential damages, and our total liability under the Program will not exceed the Commissions paid to you in the 6 months before the event giving rise to the claim.
We may change these Terms, commission rates, the attribution window, thresholds or the Program itself at any time. Changes apply going forward from the date posted; continued participation constitutes acceptance.
These Terms are governed by the laws applicable to Ettex’s place of business, without regard to conflict-of-laws rules. Disputes will be resolved in the competent courts of that jurisdiction.
